1. About this notice

This notice applies to the Fansly API service, operated by Fans Origin LLC, a limited liability company formed in Wyoming, United States, with its registered office at 30 N Gould St, Ste N, Sheridan, WY 82801. Contact: contact@apifansly.com.

It sets out our position on adult-content record-keeping, how to send us a copyright complaint, and how to respond if your access was restricted. As Section 15 of our Terms of Service provides, this page forms part of those Terms.

2. What we are

Fansly API is a developer platform. It lets our customers' software read data from, and take actions on, Fansly accounts they connect using credentials they already hold.

We host no content library. We operate no site where content is published to the public, we do not curate or recommend content, and we keep no archive of material retrieved through the Service. Where our systems transmit or briefly cache material, they do so automatically, at a customer's direction, and only to complete that customer's request.

So what we can act on is limited to what is within our control: the customer account and the API access behind the activity complained of. If the material that concerns you is published on Fansly itself, Fansly is the party that can remove it, and your notice should go there.

3. Statement under 18 U.S.C. § 2257

All records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75, to the extent any such records are required, are kept by the respective producers of the content concerned. Fans Origin LLC is not such a producer.

We are not a producer, primary or secondary, of any sexually explicit content. We do not create, film, photograph, edit, publish, curate, or advertise it, and we operate no service on which it is offered to anyone. Accordingly § 2257 and § 2257A impose no record-keeping or labelling obligations on us as a producer. Those obligations rest with the platforms and creators who produce, upload, or host the content.

Our customers commit to this too. As Section 4 of our Terms requires, every person appearing in or described by any account, content, or data reached through the Service must be an adult of 18 or over who agreed to it, and any age-verification or record-keeping duties that apply to a customer are the customer's to meet.

4. Sending a copyright notice

If you own a copyright, or are authorised to act for the owner, and believe material has been used through the Service in a way that infringes it, send a written notice to contact@apifansly.com, subject line DMCA Notice.

To be effective under 17 U.S.C. § 512(c)(3), it must include: (a) your physical or electronic signature, as the copyright owner or a person authorised to act for them; (b) identification of the copyrighted work infringed, or a representative list where one notice covers several works; (c) identification of the material to be removed or disabled, with enough detail for us to locate it — account identifiers, request details, timestamps, or URLs; (d) your name, postal address, telephone number, and email address; (e) a statement that you have a good faith belief the use is not authorised by the owner, its agent, or the law; and (f) a statement that the notice is accurate and, under penalty of perjury, that you are authorised to act for the owner.

A notice missing these may not be effective, and we may come back to you for what is missing before we act.

5. What we do with it

We aim to acknowledge a complete notice within 5 business days. Where a notice is valid and the activity is within our control, we take reasonable steps in response, which may include restricting or suspending the API access or customer account involved.

We forward your notice, including the contact details in it, to the customer affected so they can respond. Say so if you would prefer certain details withheld and we will consider it, though we cannot always act on a notice while withholding what the other side needs to answer it.

6. Counter-notification

If your access or material was restricted and you believe that was a mistake, send a counter-notification to contact@apifansly.com, subject line DMCA Counter-Notice. Under 17 U.S.C. § 512(g)(3) it must include: (a) your physical or electronic signature; (b) identification of the material removed or disabled, and where it appeared before it was; (c) a statement, under penalty of perjury, that you have a good faith belief it was removed through mistake or misidentification; (d) your name, postal address, and telephone number; and (e) your consent to the jurisdiction of the US District Court for the district of your address — or, if you are outside the United States, any district in which we may be found — and that you will accept service of process from whoever sent the original notice.

We forward a valid counter-notification to the original complainant. If they do not tell us within 10 business days that they have filed a court action to restrain the activity, we may restore what was removed, usually within 10 to 14 business days of receiving it.

7. Repeat infringers

We may suspend or terminate the account of any customer who infringes copyright through the Service, and we judge what is appropriate case by case. Where a customer repeatedly infringes, we terminate in appropriate circumstances. We keep a record of the notices we receive and act on, and take that record into account. Termination on this ground is termination for breach under Section 19 of our Terms, which means remaining Credits are forfeited.

8. Child sexual abuse material

There is no process here, because there is nothing to weigh. Any use of the Service touching material that sexually exploits or abuses a minor results in immediate termination and is reported to the National Center for Missing & Exploited Children and to law enforcement. If you believe you have encountered such material, email contact@apifansly.com with the subject line URGENT — CSAM, and report it to NCMEC at report.cybertip.org.

9. Changes and contact

We may update this notice, and will post the revised version with a new date at the top.
